Workers' Compensation and Rehabilitation - Policy

1.0                Purpose and Scope

The University of Queensland (UQ) is committed to providing high quality workers’ compensation services, work rehabilitation [1] and suitable duties programs where necessary, to all employees with a compensable injury or illness to enable them to remain at work or return to work as soon as medically practicable.

This policy outlines UQ’s obligations as a self-insurer and employer under the Workers’ Compensation and Rehabilitation Act 2003 (the Act) and the Workers’ Compensation and Rehabilitation Regulation 2014. The policy applies to all UQ employees who have sustained a work-related injury or illness that has been assessed and accepted by UQ as a workers’ compensation claim. The policy is not applicable to contractors, students, volunteers or visitors.

2.0                Principles and Key Requirements

  1. Injured employees that have an accepted workers’ compensation claim are entitled to all reasonable and necessary payments, medical treatment and rehabilitation that is appropriate in the circumstances and payable in accordance with the Act.
  2. The Work Injury Management Unit within UQ makes liability decisions according to the provisions of the Act, exercising reasonably the functions and powers of an insurer in accordance with the Act and the conditions of its self-insurance licence, without any influence from other parties. 
  3. UQ provides work rehabilitation and suitable duties programs to employees with a compensable injury or illness, to enable them to stay at work or to facilitate an early and safe return to work after injury.
  4. UQ manages its rehabilitation obligations through a return to work program in accordance with the following principles:

Priority 1: The employee returns to their original duties.

Priority 2: The employee returns to a modified version of their original duties.

Priority 3: The employee is redeployed to new duties preferably within their organisational unit, or within another organisational  unit.

Priority 4: The employee is unable to be redeployed within UQ and employment is terminated on the grounds of ill health in accordance with the Medical Conditions Affecting Performance policy and Enterprise Agreement.

3.0                Roles, Responsibilities and Accountabilities

3.1                 Work Injury Management unit

The Work Injury Management unit (WIM) within the Health, Safety and Wellness Division is responsible for administering UQ’s self-insurance workers’ compensation licence under the Act. WIM manages regulatory compliance, claims services and coordination of the development and maintenance of any necessary rehabilitation and return to work programs in consultation with the employee, employer and medical providers under UQ’s accredited return to work program. 

WIM ensures strict confidentiality of workers’ compensation medical and personal information for injured employees as a self-insurance licence requirement. Under the Act, WIM may communicate with the relevant manager about an employee’s functional capacities and fitness for work, only for the purpose of providing a rehabilitation and return to work program.

WIM will ensure that employers are advised of their rights to review of decision.

3.2                 UQ employees

UQ employees may apply for a workers’ compensation claim under the Act and if the claim is accepted, are responsible for active participation in their work rehabilitation and suitable duties program.

3.3                 Managers and supervisors

Managers and supervisors have a statutory responsibility to cooperatively work with WIM and the injured employee for the development, implementation and monitoring of suitable duties programs in order to facilitate the best possible return to work outcome for the injured person.

4.0                Monitoring, Review and Assurance

4.1                 Workers’ Compensation Regulator

Under the Act, the Queensland Workers’ Compensation Regulator may review claims decisions and appeals of claims decisions made by WIM.

Outcome data from WIM is monitored by the regulator. UQ’s compliance with its licence conditions for self‑insurance are assessed by the regulator midway through the licence period and prior to the expiry of each licence term.

4.2                 Health, Safety and Wellness Division

The Health, Safety and Wellness Division is responsible for reviewing this policy as required to ensure that it remains accurate and relevant to the needs of UQ.

WIM is responsible for monitoring and reviewing every UQ employees’ compensation claim to ensure that appropriate return to work priorities are identified and met for each person.

5.0                Recording and Reporting

WIM is responsible for recording and reporting UQ’s compensation and work rehabilitation compliance and performance outcome data to the University Senior Executive Team (USET) and the Vice‑Chancellor’s Risk and Compliance Committee on a regular basis, and to the Workers’ Compensation Regulator as required under the Act.

1.0                Purpose and Scope

The procedure defines how work rehabilitation [1] and suitable duties programs are developed, implemented and monitored at The University of Queensland (UQ) to ensure that UQ complies with its obligations as a self-insurer and employer under the Workers’ Compensation and Rehabilitation Act 2003 (the Act).

This procedure should be read in conjunction with the Workers’ Compensation and Rehabilitation policy.

This procedure applies to all parties involved in the management of a UQ staff compensation claim, including:

  • UQ employees  who have sustained a work-related injury or illness that has been assessed and accepted by UQ as a workers’ compensation claim;

  • the supervisor or manager of a UQ employee making a workers’ compensation claim;

  • UQ’s Work Injury Management unit and employees within UQ’s Health, Safety and Wellness Division; and

  • UQ’s return to work coordinator and external health professionals involved in the rehabilitation process of UQ employees.

The procedure is not applicable to UQ contractors, students, volunteers or visitors.

2.0                Process and Key Controls

  1. UQ employees who are injured at work, or whilst traveling to or from work, may lodge a workers’ compensation claim with UQ.

  2. The Work Injury Management unit (WIM) within the Health, Safety and Wellness Division assesses all claims and makes a determination in accordance with provisions of the Act.

  3. WIM manages accepted claims and liaises with the employee, supervisor and rehabilitation providers to ensure that the injured employee receives appropriate medical treatment, work rehabilitation, return to work support and any payments in accordance with provisions of the Act.

  4. WIM may cease a claim when:

    1. the employee has made sufficient recovery and progress to be deemed fit to return to full duties and no longer requires treatment; or

    2. it determines that the employee no longer suffers a work related injury or that they have reached maximum improvement.

3.0                Key Requirements

3.1                 Workers’ compensation claims and assessment

UQ employees should report any injury or illness arising from workplace activities in accordance with the Workplace Injury, Illness and Incident Reporting (UQSafe-Incident) procedure, and may also consider applying for a workers’ compensation claim. If a UQ employee attends a doctor’s appointment and is issued a workers’ compensation medical certificate in relation to the injury, they should complete the Application for Workers’ Compensation and Forms 1 to 4 (available under the Forms Tab), attach the workers’ compensation medical certificate and return to WIM promptly to enable a claims decision to be made early.

WIM determines whether an Application for Workers’ Compensation claim for an injury or illness meets the legislative requirements for the acceptance of a claim. UQ employees are required to participate and cooperate with WIM to assist with their decision making process for claims liability under the Act.

WIM must consider provision of work rehabilitation and suitable duties for a UQ employee with an accepted statutory claim and for a UQ employee with a notice of claim for common law damages.  

WIM must ensure that an employee with a compensable injury or illness is provided with appropriate treatment by registered health practitioners and is provided with approved aids or equipment.

3.2                 Work rehabilitation

Work rehabilitation aims to maintain the affected employee in their job without time off or, in cases where time off work is required, return the employee to work on suitable duties as early as possible.

UQ will manage work rehabilitation cases through:

  • Ongoing, close management of a claim within the provisions of the Act; 

  • Arranging early treatment from relevant registered health practitioners (e.g. physiotherapist, podiatrist and dentist) or provision of approved aids or equipment; and

  • Providing a suitable duties program, where considered necessary, often consisting of a graded program of work duties and hours.

3.3                 Suitable duties

WIM manages suitable duties programs for employees with a compensable injury or illness that affects their ability to perform their original duties. Suitable duties programs will be based upon each employee’s requirements as approved by their treating doctor and align with UQ’s hierarchy of return to work principles as outlined in the Workers Compensation and Rehabilitation policy. The employee’s treating doctor must approve work rehabilitation activities and the suitable duties plan, with input from other treating health professionals as sought.

In managing its suitable duties program responsibilities, WIM may:

  • engage the UQ return to work coordinator (RTWC) or an external rehabilitation professional to assess the injured employee’s capacity to participate in a suitable duties program. The RTWC or rehabilitation professional will:

    • develop, monitor and review the suitable duties program in consultation with the injured employee, the treating doctor, and the employee’s manager or supervisor; and

    • ensure that the suitable duties program is consistent with current medical and functional information that relates to the compensable injury.

  • consider temporary placement of the injured employee in an alternative business unit for the purpose of meeting suitable duties and return to work needs. The local business unit pays wages for the hours worked.

When the suitable duties program involves a graduated schedule of hours, the local business unit pays the injured employee’s wages for the hours worked, with supplementary payment from WIM.

Formal review of the suitable duties program, its suitability for the injured employee’s needs and reasonable progress may be conducted by an independent medical specialist under the Act.

4.0                Roles, Responsibilities and Accountabilities

4.1                 UQ employees

UQ employees must comply with this procedure when making a workers’ compensation claim and participating in rehabilitation and suitable duties programs. UQ employees must also cooperate with WIM in its management of workers’ compensation and rehabilitation at UQ, including but not limited to:

  • notifying WIM of any material changes of condition or treatment;

  • taking reasonable steps to ensure recovery from the compensable injury or illness;

  • advising their supervisor and WIM immediately if their condition worsens;

  • ceasing any task that may have adversely affected their condition and report this immediately to their supervisor or WIM; and

  • attending any medical examination arranged by UQ for the purpose of assessing or reviewing their condition.

4.2                 Work Injury Management unit (WIM)

WIM manages UQ’s workers’ compensation and rehabilitation responsibilities, and its overarching role is to ensure that timely and accurate liability decisions are made and optimal work rehabilitation outcomes for all parties are reached.

WIM is responsible for managing regulatory compliance, claims services and coordinating the development and maintenance of a rehabilitation and suitable duties program in consultation with the affected employee, employer, medical providers and allied health professionals under UQ’s accredited return to work program.

WIM will ensure that employees are advised of their rights of review. Where a workers’ compensation claim is either not accepted or ceased, the employee will be provided with reasons for this decision in writing. A review of the decision can be requested from the workers’ compensation regulator.  If the employee is dissatisfied with the regulatr’s decision, further review can be requested  to be heard and decided by the Industrial Relations Commission.

4.3                 Return to work coordinator or external rehabilitation professional

The Ergonomics and Rehabilitation Adviser, within the Health, Safety and Wellness Division, is appointed as UQ’s return to work coordinator and provides guidance and support for suitable duties programs when required.

WIM may engage an external rehabilitation professional to assess the injured worker’s capacity to participate in a suitable duties program and if appropriate, develop and monitor the suitable duties program in consultation with the affected employee, supervisor and medical provider.

4.4                 Supervisors and managers

The injured employee’s supervisor or manager must work collaboratively with WIM and the return to work coordinator to ensure that all feasible strategies are in place for the employee’s suitable duties plan and return to work program, including monitoring their arrangements daily.

5.0                Monitoring, Review and Assurance

5.1    Periodic reviews

The Health, Safety and Wellness Division is responsible for reviewing this procedure as required to ensure that it remains accurate and relevant to the needs of UQ.

The WIM unit:

  • reviews the system of work rehabilitation and suitable duties in consultation with all relevant parties and ensures that return to work outcomes are considered within the review; 

  • monitors claim liabilities, costs, durations and reasonableness of treatment provided, and where required, requests specialist opinion to determine treatment and claims strategy; and

  • conducts formal mid-plan and end-of-plan review of suitable duties in consultation with the treating doctor, return to work coordinator or rehabilitation professional and injured employee. Formal review may also occur when rehabilitation needs have changed sufficiently to justify a change in the plan or when rate of progress is less than documented within the plan.

The return to work coordinator or external rehabilitation professional:

  • conducts scheduled regular review of work rehabilitation and suitable duties progress in consultation with WIM, the injured employee, supervisor or manager and treating doctor.

A response to the complaint will be made in the first instance within 14 days of receipt of the complaint. WIM will explain actions, processes and reasoning and will remedy any agreed inadequacies, however WIM may not be able to comment in depth on claims related issues which are subject to review by the Workers’ Compensation Regulatory Services and/or legal appeal.  Similarly, it may not be appropriate to comment on UQ management policies and interaction outside the direct workers’ compensation process.

6.0                Recording and Reporting

WIM oversees all of UQ’s recording and reporting activities in relation to workers’ compensation and rehabilitation, including:

  • regular reports to UQ senior management and the Vice-Chancellor’s Risk and Compliance Committee regarding claims liability, management and rehabilitation processes; and

  • monthly reports to the Workers’ Compensation Regulator regarding claims details and return to work outcomes. 

The return to work coordinator or external rehabilitation professional:

  • reports progress updates and suitable duties outcomes to WIM, the injured employee, their supervisor or manager, and the treating doctor; and

  • records work rehabilitation progress notes, work rehabilitation and suitable duties plans.

Lodging a Claim for Workers’ Compensation - Guidelines

1.0    Purpose and Scope

This guideline outlines how to lodge a claim for workers’ compensation at The University of Queensland (UQ) and should be read in conjunction with UQ’s Workers’ Compensation and Rehabilitation Policy and Procedure.

2.0    How to Lodge a Claim for Workers’ Compensation

Should you wish to lodge an application for compensation for a work-related injury, you will need to submit the below forms to UQ’s Work Injury Management unit (WIM).

  1. Application for Workers’ Compensation Form - Mandatory. Please ensure this form is signed by you and a witness on page 4. NOTE: this witness does not need to be a witness of the incident, they are simply witnessing your signature.

  2. Form 1 - Mandatory. Please include details of all doctors / hospitals / other treatment providers whom you have attended in relation to the claimed injury.

  3. Form 2 - This form is only required if there was a witness to the injury. If so, this form will need to be completed by the witness.

  4. Form 3 - Mandatory. You must declare all previous similar injuries. If you have not had any similar injuries, please record “Nil” on the form.

  5. Form 4 - This form is a mandatory requirement if your injury occurred while you were travelling to or from work, or on a break from work (e.g. lunch break).

  6. Workers' Compensation Medical Certificate - Mandatory. This certificate needs to be completed by a doctor who attended you in relation to the claimed injury and submitted to WIM. You will need to attend a doctor and ask for a workers’ compensation medical certificate for the injury.

Please ensure all sections of the forms are completed fully and accurately, and all forms are signed and dated.

3.0    After Claim Lodgement

You will receive acknowledgement of your claim lodgement from WIM within one business day.

Once your claim is lodged with WIM, WIM have 20 business days to investigate and determine (accept or reject) your application.

4.0    Medical and Allied Health Treatment

While your claim is pending, you are free to seek medical treatment at your own expense.  If your claim is accepted, WIM will reimburse you for out-of-pocket medical expenses, up to the amounts specified in the WorkCover Queensland Tables of Costs.

Prior to engaging any medical or allied health treatment, please advise the service provider that the treatment relates to a workers’ compensation claim, and ascertain if they charge fees pursuant to the WorkCover Queensland Tables of Costs. If your chosen treatment provider charges more than the amounts set out in the Tables of Costs, you will be responsible for the ‘gap’ payment, which will not be reimbursed if your claim is accepted.

If your claim is rejected, medical and allied health treatment expenses will remain your responsibility.

5.0    Support While Your Claim is Pending

If you require return to work assistance to accommodate your injury in the workplace, please contact your supervisor, HR Representative, or Safety Coordinator (WHSC).

There are a number of services that may be of assistance to you whilst your claim is being determined:

  • UQ’s Employee Assistance Program, provided by Benestar, which can be contacted on 1300 360 364.

  • Workers Psychological Support Services which can be contacted on 1800 370 732.
