1. Purpose and Objectives

This policy provides for withholding of salary and other payments including allowances to staff or visitors in circumstances where a period of lawful detention is imposed or a period of lawful imprisonment is to be served.

2. Definitions, Terms, Acronyms

Authorised Officer – the officer authorised to exercise the relevant HR power or function in accordance with the HR Authorisation Schedule

Visitor – person, other than a student or a paid staff member, who receives payment of any type from the University. This includes but is not limited to Visiting Academics, Visiting Scholars and Occupational Trainees.

3. Policy Scope/Coverage

This policy applies to University staff and visitors who are serving a period of lawful imprisonment or lawful detention.

4. Policy Statement

A staff member or visitor who is lawfully detained or serving a period of lawful imprisonment may have their salary or allowances withheld during the period of lawful imprisonment or lawful detention. Staff can in such circumstances apply to take accumulated long service and recreation leave entitlements for this period where eligible, in accordance with the relevant policy and procedures. The Authorised Officer can however determine each case individually in regard to payment of salary, allowances or any contribution of superannuation where applicable.

1. Purpose and Objectives

These procedures enact PPL 5.50.13a Withholding of Payments During a Period of Imprisonment or Detention – Policy.

2. Definitions, Terms, Acronyms

Enterprise Agreement - The University of Queensland Enterprise Agreement 2014 – 2017

Visitor – person, other than a student or a paid staff member, who receives payment of any type from the University. This includes but is not limited to Visiting Academics, Visiting Scholars and Occupational Trainees.

3. Procedures Scope/Coverage

These procedures apply to University staff and visitors who are serving a period of lawful imprisonment or lawful detention.

4. Procedures Statement

The affected staff member or visitor should if practicable inform their supervisor or the relevant Head of organisational unit as soon as possible that they will be unable to attend to their duties at the University.

It will be of no detriment to a staff member or visitor in the event they are unable to contact the relevant supervisor or Head of organisational unit.

Where the nature of the charge (and any subsequent conviction and sentencing) may need to be considered in the context of Misconduct/Serious Misconduct in accordance with the Enterprise Agreement, or Research Misconduct (PPL 4.20.05), the Head of the organisational unit should inform the Director, Human Resources.
